Pocketpair, the developer embroiled in a legal dispute, unexpectedly released its 2019 title, OverDungeon, on the Nintendo eShop. This action card game, blending tower defense and roguelike elements, marks Pocketpair's first Nintendo Switch release. The launch, announced without prior fanfare, coincided with a 50% discount running until January 24th.

The company's move comes amidst an ongoing lawsuit filed by Nintendo and The Pokémon Company in September 2024, alleging patent infringement related to Pocketpair's popular game, Palworld. The lawsuit centers on similarities between Palworld's Pal Spheres and Pokémon's creature-capturing mechanics. Despite the controversy, Palworld received a major update in December, boosting its player count. The OverDungeon release on the Nintendo eShop is viewed by some as a strategic response to the ongoing legal battle.

The timing of OverDungeon's Nintendo Switch debut, given Palworld's availability on PS5 and Xbox, has sparked speculation. While Palworld is Pocketpair's most well-known title, it's not the first to draw comparisons to Nintendo properties. Their 2020 release, Craftopia, bore similarities to The Legend of Zelda: Breath of the Wild.

Despite the lawsuit, Pocketpair continues to update Craftopia and actively promotes Palworld, including a recent collaboration with Terraria and plans for future content, a Mac port, and a potential mobile version in 2025. Details regarding the ongoing legal proceedings remain scarce, with patent experts suggesting the case could extend for years. The OverDungeon launch adds another layer of intrigue to the unfolding situation.
