Canada: There is currently no federal legislation governing EDR data privacy. However, insurers typically obtain owner consent as a best practice.
United States: In December 2015, the Driver Privacy Act was enacted, placing restrictions on who can access EDR data and affirming that such data belongs to the vehicle owner or lessee. Seventeen U.S. states have passed additional laws regulating EDR data retrieval, including Arkansas, California, Colorado, Connecticut, Delaware, Maine, Montana, Nevada, New Hampshire, New Jersey, New York, North Dakota, Oregon, Texas, Utah, Virginia, and Washington. Most require vehicle owner consent before downloading EDR data, with limited exceptions.
